早在2004年央视举办青年歌手电视大奖赛时，凤凰传奇就曾凭借《月亮之上》取得通俗唱法组第七名的好成绩，当时的评委会成员包括金兆钧、徐沛东、李双江等知名音乐人，如果他们此次真因为抄袭之说上不了春晚，那与当年的央视青歌赛获奖岂不是自相矛盾。

《月亮之上》其旋律涉嫌抄袭英国组合Blue的旧作《AllRise》。央视春晚剧组透露，凤凰传奇组合还参加了春晚第五次彩排，但剧组随后开会时决定把这首歌拿下，因为剧组在调查后发现这首歌有19处涉嫌抄袭。对于歌曲涉嫌抄袭所引发的争议，凤凰传奇的经纪人邓先生坚决予以否认。“他绝对没有抄袭，这首歌是根据蒙古族民歌而创作的，他们是在发扬民族音乐。”作为《月亮之上》的词曲作者，何沐阳透露这首歌创作于1999年，原本是一首慢板歌曲，歌名叫《想你的人》，后来根据凤凰传奇的演唱风格和声音特点进行了重新编曲，创作成为《月亮之上》。有观点认为《月亮之上》的男声说唱部分几乎是对Blue歌曲《AllRise》的原样照抄，甚至连长度都一样，都是21秒。何沐阳回应道：“他的确是借鉴了现在流行的说唱节奏，但节奏相似就说是抄袭，未免有些武断了。

来回就折腾那几个音符，“资源”早晚要枯竭，那么，以后的作品必定会抄来抄去。其实有部分相同没什么，只要风格和情感不同就行了。同一首歌因为演唱者风格和情感运用的不同会觉得差异很大，只有细微的相同之处也会觉得与原作品面目全非的。

有细心的人还特意数了〈月亮之上〉的抄袭之处，居然费心的找出19处之多，可谓用心良苦。最近，抄袭之风盛行，一经检举，必遭铺天盖地的批评，“涉案人员”也基本被打入冷宫，似乎永世不得翻身。《月亮之上》也正因此而被高傲的春晚离弃，估计死到临头了。一定又会有很多人跳着高大骂，毕竟抄袭是小人所为，也该受到严厉制裁。

之前已经发生过多次类似事件，如花儿乐队的〈喜唰唰〉等等。最近关于音乐作品因抄袭对薄公堂的也很多，几乎都是正在流行的歌曲。那么，是否该给抄袭重新定位呢？究竟相似到什么程度才算是抄袭呢？——终究有一天几个音符的排列组合形式会被用完，那么以后的所有作品就都是抄袭了？毕竟只是那几个音符反复的排列才组成的新作品，也就很容易重复，就是所谓的抄袭。哪个作曲家的记忆力会那么好呢：能记住曾经被别人编排过的所有小节或者曲调，而费尽心机的从乱如缠麻的音符中杀出一条与众不同的“血路”，而诞生新作品。那新作品的诞生也太难了点，几乎步步为营，稍有不慎就容易和别人曾经的作品相同。是不是该成立一个组织，清晰定位抄袭的范围，专门审核新作品是否抄袭。

为什么凡是被指抄袭的作品都是非常受欢迎的作品呢？而且原来的作品大多不为人知，水平也不怎么样，如果不是因为抄袭事件的发生它们根本就只是历史的灰尘，连一点凡响也没有。我本人很喜欢音乐，也很喜欢诸如《月亮之上》和〈喜唰唰〉之类的被称为抄袭来的低级趣味的作品，而且我听了无数遍也没有听出它们是抄袭了哪个作品。只觉得这些作品也很好，清新而与众不同，即使抄袭也使原来暗淡无光的作品经过再加工而变的光芒万丈，原作者是否该感谢新作者呢？也听过很多歌似乎都有雷同现象，难道都是苦心积虑的抄袭？

我觉得应该重新定义“抄袭”的范围或者含义，否则以后抄袭事件会更多。哪个歌手或者作者会知道世界各地不同时期不同作品的详细情况呢？而且有时候人的灵感也是相同的，巧合的事还少吗？

也痛恨不劳而获的抄袭者们，但也不能草木皆兵。也应该尊重创作者的才华和劳动成果。是巧合还是别有用心的借鉴?真是该准确定位抄袭的范围，做到不冤枉好人，也不放过“坏人”。
